TERMS OF USE

Welcome to BalkanBuzz (hereinafter: the "Platform", "BalkanBuzz", "we"). These Terms of Use (the "Terms") govern your access to and use of the website and all related services (tracking song trending positions, user accounts, search, newsletter, etc.). By accessing the website or registering an account, you confirm that you have read, understood, and accepted these Terms. If you do not agree with any part of the Terms, please do not use the Platform.

1. About the platform

BalkanBuzz is an online platform that allows users to track the trending positions of music tracks on YouTube in real time, for Serbia, Bosnia and Herzegovina, Croatia and the wider region, including the diaspora. The Platform is intended for musicians, managers, record labels, and anyone who wants insight into how their music, or the music of other artists, ranks on trending lists.

Data on positions, views, and trends shown on the Platform is based on publicly available YouTube data and is processed and displayed for informational purposes. BalkanBuzz is not affiliated with, sponsored by, or endorsed by YouTube LLC or Google LLC, nor is it their official partner.

2. Definitions

  • User – any individual or legal entity that accesses the Platform or registers on it.
  • Account – a user profile created by registering on the Platform.
  • Content – all texts, data, graphics, marks, design, and other materials available on the Platform.

3. Registration and user account

3.1. To use certain features of the Platform (e.g., tracking positions, personalized overview), a user account must be created via the registration page.

3.2. When registering, the user must provide accurate, complete, and up-to-date information. BalkanBuzz is not liable for the consequences of entering inaccurate or incomplete information.

3.3. The user is solely responsible for keeping their login credentials confidential and for all activities carried out through their account. If you suspect unauthorized use of your account, you must notify us immediately using the contact details listed in Section 13.

3.4. The account is intended for personal or business use by the person who registered it and may not be transferred to third parties without BalkanBuzz's consent.

3.5. Registration is permitted only for persons at least 16 years of age. If you are a minor, registration may only be carried out by your parent or legal guardian, in accordance with applicable regulations.

4. User obligations and rules of conduct

By using the Platform, the user agrees not to:

  • use the Platform for unlawful purposes or in a way that violates the rights of third parties;
  • enter inaccurate, offensive, false, or misleading information;
  • attempt unauthorized access to systems, databases, or other users' accounts;
  • use automated tools (bots, scrapers, etc.) to mass-collect data from the Platform without BalkanBuzz's prior written consent;
  • disrupt the operation, security, or integrity of the Platform (e.g., by introducing malicious code, overloading servers, etc.);
  • use the Platform to send unsolicited communications (spam) to other users or third parties.

BalkanBuzz reserves the right to temporarily or permanently disable access to the account of a user who violates the above obligations, without prior notice, in accordance with Section 11.

5. Third-party content and data

5.1. Data on song positions, view counts, and trends shown on the Platform is sourced and processed based on publicly available information from the YouTube platform. BalkanBuzz makes reasonable efforts to ensure this data is accurate and up to date, but does not guarantee its absolute accuracy, completeness, or availability at all times, as it depends on data sources outside BalkanBuzz's control.

5.2. Content displayed on the Platform does not constitute a guarantee of future success, popularity, or commercial outcome for any music track or artist.

5.3. Song and artist names and related materials (e.g., cover art, clips) may be owned by third parties and are shown solely for informational and reference purposes.

6. Intellectual property

All elements of the Platform that are not third-party data – including the name "BalkanBuzz", logo, visual identity, design, software, texts, and site structure – are the property of BalkanBuzz or its licensors and are protected by copyright, related rights, and trademark law. Copying, distributing, modifying, or commercially using these elements without prior written consent is prohibited.

7. Newsletter and marketing communication

By signing up for the newsletter via the form on the website, the user agrees to occasionally receive notifications, news, and marketing content related to the Platform at the provided email address. The user may unsubscribe from the recipient list at any time via the unsubscribe link included in every email, or by sending a request to the contact email listed in Section 13. Details on the processing of personal data in this context are described in the Privacy Policy.

8. Service availability and free use

8.1. BalkanBuzz strives to ensure continuous availability of the Platform but does not guarantee uninterrupted, timely, secure, or error-free operation of the Platform. We reserve the right to temporarily suspend access from time to time for technical maintenance, improvements, or other justified reasons.

8.2. If the Platform currently offers features free of charge, BalkanBuzz reserves the right to introduce paid packages or premium features in the future, of which users will be notified in advance, along with the specific terms that will apply to such services.

9. Limitation of liability

9.1. The Platform and its content are provided "as is" and "as available", without warranties of any kind, express or implied.

9.2. BalkanBuzz is not liable for: (a) damage arising from the unavailability of the Platform; (b) decisions the user makes based on data shown on the Platform; (c) inaccuracies in data obtained from third-party sources; (d) consequences of unauthorized access to a user's account that did not occur due to BalkanBuzz's fault.

9.3. Nothing in these Terms excludes or limits BalkanBuzz's liability to the extent that such exclusion would be contrary to the mandatory regulations of the Republic of Serbia.

10. Changes to the Terms of Use

BalkanBuzz reserves the right to amend these Terms from time to time, and users will be notified by the publication of an updated version on this page, indicating the date of the last change. Continued use of the Platform after published changes is considered acceptance of the amended Terms.

11. Account termination and suspension

The user may request deletion of their account at any time using the contact details listed in Section 13. BalkanBuzz reserves the right to suspend or terminate the account of a user who violates these Terms, and will endeavor, where possible, to notify the user beforehand.

12. Governing law and dispute resolution

These Terms are governed by the law of the Republic of Serbia. In the event of a dispute, the parties will attempt to resolve it amicably, and if that is not possible, the competent court in Belgrade shall have jurisdiction.
